These Terms of Service govern your use of SurfNav. By accessing or using SurfNav, you agree to these terms.
SurfNav provides surf forecasts, rankings, recommendations, routing information, and related decision-support tools. SurfNav does not guarantee forecast accuracy, wave conditions, weather, water quality, crowd levels, travel times, beach access, equipment suitability, or that any surf session will be safe or enjoyable.
Surfing and ocean activities involve inherent risks, including changing waves, currents, tides, weather, marine life, water quality, collisions, equipment failure, injury, and death. You are responsible for assessing current conditions, your ability, your equipment, local rules, and whether it is safe to enter the water. Do not rely on SurfNav as a substitute for your own judgment, official warnings, lifeguards, emergency information, or local expertise.
You are responsible for information and credentials associated with your account. You may not misuse SurfNav, interfere with the service, attempt unauthorized access, abuse automated interfaces, scrape or redistribute protected service content unlawfully, or use SurfNav in a way that violates applicable law or the rights of others.
If SurfNav offers paid plans, pricing, billing frequency, renewal terms, and any applicable trial terms will be disclosed before purchase. Unless otherwise stated at checkout, subscriptions may renew automatically until canceled. Additional payment and refund terms may be provided at purchase.
SurfNav may rely on third-party data, maps, routing, weather, marine, analytics, authentication, AI, hosting, payment, media, and social-platform services. Their availability and accuracy are outside SurfNav's control, and your use of some connected services may also be governed by their terms.
SurfNav and its original software, branding, interface, models, text, graphics, and other original content are protected by applicable intellectual-property laws. These terms do not transfer ownership of SurfNav intellectual property to you.
SurfNav may change, suspend, add, or remove features and may experience downtime or data-provider interruptions. We may update these terms as the service evolves. Continued use after an updated version becomes effective constitutes acceptance of the revised terms where permitted by law.
You may stop using SurfNav at any time. SurfNav may restrict or terminate access when reasonably necessary to protect the service, users, third parties, or comply with law, including in response to abuse or material violations of these terms.
To the maximum extent permitted by law, SurfNav is provided on an "as is" and "as available" basis without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or that recommendations will match actual conditions.
To the maximum extent permitted by law, SurfNav and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or reliance on the service. Nothing in these terms excludes liability that cannot legally be excluded.
