1. Acceptance of these terms

These Terms of Service govern your use of SurfNav, including its surf forecasting, recommendation, account, feedback, analytics, and social-publishing features. By using SurfNav, you agree to these terms. If you do not agree, do not use the service.

2. What SurfNav provides

SurfNav provides informational surf forecasts, surf-spot comparisons, board and session recommendations, and related tools. SurfNav may also allow authorized users to create, prepare, or publish SurfNav-related content to third-party social platforms.

3. Surf conditions and safety

Surf forecasts and recommendations are estimates and may be incomplete, delayed, or incorrect. Ocean and weather conditions can change rapidly. You are responsible for evaluating local conditions, posted warnings, your own ability, equipment, and personal safety before entering the water. SurfNav is not an emergency, weather-warning, or lifesaving service.

4. Accounts and authorized access

You are responsible for activity performed through your SurfNav account and for keeping your credentials secure. If you connect a third-party account, including a social-media account, you authorize SurfNav to use the access you approve solely to provide the requested connected features, subject to that platform's terms and permissions.

5. Social publishing

If you choose to connect a supported social platform such as TikTok, SurfNav may use the permissions you grant to prepare or publish content on your behalf. You remain responsible for reviewing content before publication where a review step is provided and for ensuring that anything you publish complies with applicable law and the third-party platform's rules. You may revoke third-party authorization through the applicable platform's account settings where supported.

6. Acceptable use

You may not misuse SurfNav, interfere with its operation, attempt unauthorized access, use the service to distribute unlawful or infringing material, or use connected-platform features in a manner that violates the rules of the connected platform.

7. Intellectual property

SurfNav and its original software, branding, interface, and service content are protected by applicable intellectual-property laws. These terms do not transfer ownership of SurfNav intellectual property to you. You retain rights you otherwise hold in content you provide.

8. Third-party services

SurfNav may rely on or link to third-party services, data providers, hosting providers, mapping services, social platforms, and other external systems. Those services are governed by their own terms and policies, and SurfNav does not control their availability or actions.

9. Service changes and availability

SurfNav is an evolving service. Features may be added, changed, suspended, or removed, and the service may occasionally be unavailable. We may update these terms as the service evolves. The current version will be posted on this page with an updated effective date.

10. Disclaimers

SurfNav is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee uninterrupted availability, forecast accuracy, recommendation accuracy, or that the service will meet every user's needs.

11. Limitation of liability

To the maximum extent permitted by law, SurfNav and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, including decisions made based on surf forecasts or recommendations.
